Archive Findings
The 1994 workshop discussed how to handle existing sensitive disposal wells that had been approved before the new requirements. The solution was not a blanket exemption. Grandfathered wells could be accepted as meeting qualifying criteria, but new monitoring and testing requirements still applied. The workshop also said waiver decisions should depend on technical merit, mitigation factors, hydraulic isolation, and the ability of monitoring to detect mechanical failures that could affect groundwater.

For a legacy well, separate the question into three parts: initial construction history, evidence available today, and ongoing obligations. If requesting a waiver, state exactly which requirement is being waived and what alternative evidence proves the same risk is controlled. A strong waiver request explains cement and casing history, hydraulic isolation, groundwater protection, packer testing, annular monitoring, and why the remaining risk is acceptable. Avoid arguing only that the well is old or previously approved.
Current Guidance
Current Directive 051 still recognizes grandfathered wells approved before March 1, 1994, but logging waivers must be supported with information identified in section 6. Current monitoring requirements include injectivity and annular pressure monitoring, hydraulic isolation logging where applicable, packer isolation testing as per Directive 087, and well summary/completion schematic requirements.
