How to Submit a Transfer of Approval Application

Overview

A Transfer of Approval application is used when the holder of an AER scheme approval is changing. These transfers are referenced under Directive 065, Unit 5, and apply to approvals associated with enhanced recovery schemes, gas storage schemes, and experimental schemes. The purpose of the application is to show the change in approval holder and confirm that the scheme will continue to be managed in accordance with regulatory requirements.

This guide summarizes the general process for preparing and submitting a Transfer of Approval application through the AER Digital Data Submission system.

When This Process Applies

A Transfer of Approval is required when a scheme approved under the Oil and Gas Conservation Act changes ownership or approval holder. Section 15.005(1)(f) of the Oil and Gas Conservation Rules requires the applicant to amend the approval to show the change of holder when all or part of a scheme has been sold or disposed of to another party.

Only one application should be submitted for each field when requesting a change in approval holder for multiple scheme approvals. The application should identify the relevant approval numbers, approval type, and current approval holder.

Required Application Content

The application should include a clear summary of the approval being transferred, the approval number, approval type, current holder, proposed new holder, and any other relevant scheme information. It should also include the approval and supporting data needed to explain the transfer.

Directive 065 references Appendix D for the transfer documentation. The supporting material should be complete, signed where required, and consistent with the information entered into the DDS application.

DDS Submission Process

To prepare the application, log into the DDS system. Under AER applications, choose Submit Applications and select Directive 065. Enter the file number in the upper-right area of the application where applicable.

Complete the application information section by adding the applicant. This will require the applicable BA code and contact information. In the application type section, select Approval Transfer and provide a concise application description.

In the ownership and notification section, describe the ownership and formation information. For example, the application may describe the percentage being transferred and whether notification has been completed in accordance with the requirements for the application.

The future applications section may also ask whether there are any outstanding concerns. Answer these questions carefully and ensure the application package is consistent with the responses provided.

Key Considerations

Before submission, confirm that the correct approval numbers and approval holder information are being used. Incomplete ownership information, unclear notification details, or missing transfer documentation can delay review. If multiple approvals are involved, ensure they are grouped appropriately and that the application clearly explains the transfer.

Operators should also confirm that the transfer documentation aligns with the transaction and that the proposed approval holder has the necessary information to manage the approval after transfer. Clear documentation helps reduce questions during review and supports a smoother transition.
